CHARTER CONDITIONS OF NAVIS YACHTING CROATIA

Charter fee and payment conditions
The charter fee includes charter of a yacht with belonginngs i.e. equipment and full insurance for the yacht and crew during the charter period, as indicated in charter contract between parties. Port duties, local taxes, when out of base marina, fuel, skipper, hostess, transit log, final cleaning and other extra services if any, are not to be considered as charter fee.
The chartered yacht with equipment is ready for usage, i.e. charter, when payment of agreed amounts is done under following payment conditions:

- 30% or 50% of the charter fee upon signature of contract between parties involved
- 70% or 50% of the charter fee, at least four weeks before commencement of the charter

Charter of yachts is to be considered final ( closed) upon Charterer remitts nor transfer contractualy agreed amount to Charteree account within four (4) to maximum six (6) banking days and/or when invoice has been sent by Charteree to Charterer i.e. client.

Yachts Security deposit
The security deposit has to be done in starting marina by the Charterer when taking over of the yacht. Deposit can be made and accepted in: cash, cheques or credit cards. The security deposit shall be refunded in full amount unless the existance of damage or a defect on the yacht or the equipment is founded during The Takeover of the yacht, and unless there are no claims announced priorly. In case of loss or damage off the equipment, particular parts of the yacht or the yacht itself, Charteree shall retain exact (TBA) amount, which matches the value of repair, acquisition and/or purchasing the equipment or particular part of the yacht.

In case the caused damage has the consequence that yacht cannot be further chartered, Charteree has the right to retain the amount which to match the loss of profit.

Charteree obligation
The Charteree is obligated to hand-over yacht (s) to Charterer's disposal, without any fault, clean and dry with full fuel and water tanks in the agreed time and place.
If for any reason Charteree didn't fulfil above-mentioned conditions Charterer has right to claim for money refund, for the exact number of days he was not been able to use the yacht.
If the Charteree is not able to deliver the yacht to disposal, to the agreed location, 24 hours after the expiry of the time period for Takeover Of The Yacht, or provide another, at least identical/similliar or with better characteristics, the Charterer has to legal right to give up the contract and request the total amount of the charter fee and/or to request the exact recompensation of calculated amount, for number days Charterers could have yacht on dissposal.

The Charterer is able to claim only the charter fee amount, as any other rights to indemnification are excluded.

In case of damage or any other malfunctions on the yacht, and/or equipment/belongings of yachts, caused by the normal conditions of yacht usage the Charterer is obligated to inform the Charteree immediately.

The Charteree is obligated to remove/remdy problem failure or damage upon notification within time indicated herebelow.

If the Charteree is able to remdy the failure/malfunction/of the damage within hours, the Charterer has no right to require any reimbursement whatsoever.

Takeover the yacht
The Charterer will take over the yacht at agreed time and place. During takeover over the yacht, the Charterer is obliged to check and carefully examine the condition of the yacht and equipment on board according to the inventory list of the yacht.

Any possible complainments have to be notified before the start of navigation/ usage of yachts. The possible unknown defaults/issues, on the yacht or equipment on board, for which The Charterer at the moment of takeover was not familliar with in any case, as well as defaults which could arise/overcome after the takeover of the yachts, does not give option/ right to the Charterer to reducts the charter fee.

When requested by Charteree, the Charterers i.e. person(s) in charge for sailing/navigation, have to proove that they are capable to operate yacht safely and according to international maritime laws/rules. Furthermore if the Chartreres does not comply with regulations relative to boat/yacht seaworthiness, charteree and/or his representatives have legal right not to deliver the yacht at all and/or not to permit sail out from starting point/marina.No any resompensation/ request from Charteree can not be claimed. If any similiar situation has happen, Charteree is allowed to request assistance from Port Authority Police/Coast Guard. If the Charterer does not takeover the yacht within 48 hours for any reason, the Charteree is entitled to consider that the contract between parties is void/not vaild any more.

Charterers obligation
After the Charterer has takeover the yacht, the Charterer shall bear all expences of the daily berth in the port, or in marina, coast of fuel, oil, water, cleaning and all other necessary items for safe navigation, as well as eliminating all damages and defaults, which can appear while the yacht is charterer's responsibility and which are not results of normal regular yacht usage, provided the Charterer has previously contacted The Charteree and reached an agreement in regards to technical issues of the repairs that are to be peformed.

The Charterer is obliged to sail/navigate within the Croatian territorial waters. If Charterers are to leave Croatian territorial sea waters, the Charterer is obligated to request from the Charteree licence and/or permission to take such action.
The Charterer undertakes to respect all regulations and rules, to take care of the yacht and its equipment with caution and navigate/operate same carefully and according to the maritime rules of navigation and sail only during safe weather conditions and good visibility. Charterers are to be informed about wheater conditions via radio (VHF).

The Charterer, or skipper, hereby confirme that he is familiar with all necessary navigational skills and that he possesses the valid license/certificate to navigate at the open seas, and the radiophone operations authorised certificate, which has to be presented/shown to the Charteree, as per first request of same.

The Charterer undertakes and hereby agree that he shall not sub charter the yacht or rent it to the any third person(s), that he shall not participate in regattas nor yacht races, commercial purposes, any type of fishing, or sailing schools.
It is hereby agreed that Charterers will not navigate/operate the yacht under influence of alcohol or narcotics, and/or any other illegal substances unknown to Charteree. It is strictly forbbiden to tow of any other yacht, neither is allowed to sail at night by unsafe weather conditions.
Number of persons aboard of the yacht is to match to the crew list.
The Charterer is responsibile for the consequences, which may arrise of non-observance to his obligations.

Any accidents or damage the yacht or equipment/belongings of the yacht, during the charter time, the Charterer is dully obligated to inform the Charteree immediately without any time delay. 24 hours telephone numbers, which are to be used to notify the Charteree, as same are indicated in the yacht documents.

The Charterer is fully obliged to notify the Charteree immediately, and the authorities in case the yacht or equipment is missing.
If the further safe navigation is not possible or in case yacht was dispossessed by third parties which are not part of contract, prized or if further navigation was prohibited by authorities or third parties for any reasons. If the Charterer is to be fully responsible for all the consequences for the Charteree and he guarantees for them.

Any pets (dogs, cats, birds and similar) on the yacht is prohibited, unless a previously is been agreed otherwise in that respect.The Charterer is obliged to check daily oil level in the engine, check any possible lickages, control pressure of oil and cooling watter system, unusuall sounds, and take care of sails because they are not insured by insurance policy.


Charterers liability
For the damage caused by actions and failure of the Charterer for which Charteree is liable to the third party if any, the Charterer is obligated to recompensate financialy any damages to Charteree fully, whether it is the case of material and/or legal expenses that resulted from such actions and failures.

The Charterer is explicitly liable for the yacht in case any official authority repossess yacht, due to inappropriate and illegal actions undertaken during the agreed charter time.

Charterer is obliged to bear all charges/expences for failures done by himself, for which Charteree has criminal and financial responsibility.
Charterer is fully responsible for yacht repossesion by foreign state authorities in regards to any illegal actions.

In the case of damage or accident Charterer is entitled to inform in writing, authorities (Port HQ, Police, Medical Institutions) and the Charteree in case of disappearance of the yacht, impossibility of operating the yacht and/or any other actions performed by third persons and/ or legal represntatives of goverment.

The Charterer allowed to sail out from safe berth or anchorage, untill any possible failure is repaired properly.

The Charterer is not allowed to sail out from safe berth or anchorage, without been assured that fuel and water tanks levels are acceptable according to measuring instruments. Charterer is not allowed to leave safe berth and/or anchorage also if weather conditions does not allow so and if persons on board of yacht and yacht itself is not safe for normal manuvering/sailing generally.


Hand Over Of The Yacht
The Charterer is obliged to return the yacht in agreed time and place as agreed in contract at safe berth.The yacht should be returned with full fuel tank. If the hand overt is not possible at the agreed time and place for any reason, the Charteree to be notified immediately in order to consult next step of this operation.

It is clearly stated herein that Charterer is informed/suggested that he should return yacht to agreed port and/or marina at least one day before charter contract is to be considered terminated.

If such situation occures i.e. if Charterer hands over yacht when the contractual agreed time for delivery of yacht has expired, Charterer is obliged to bear all below stated expences/settlments:
. For the delay up to max three (3) hours - Entire day rental amount. For the delay of more than three (3) hours - Four days rental amount + all any other expences
. For the delay caused by bad weather conditions, Charterer is obliged to bear all expences of Charteree

Weather conditions are not to be considered as justified reasons for any possible delay of hand over.
Charterer must report all possible damages to Charteree during hand of yacht. All possible damages to be settled on Charterers account. Based on inventory list done during Take Over Operation, the yacht, equipment/belongings and machinery is to be inspected carefully. If during inspection is determinated that some problems persists, Charterer is obliged to bear all expences on his own account.
Yacht is to be hand over cleaned, as it was delivered, and tided, without any personal belongings of Charterer and his crew. Hand over operations of yacht takes about one hour time.

Insurance
The insurance is determined by the terms and conditions defined by insurance company where yacht is insured.Yacht and crew are insured against possible damage done by third persons. Terms and conditions of insurance are to be delivered to Charterer during Take Over Operations. In case of damage Charterer is obliged to report same, to nearest port authorities office, where damage log/record, will be made for the insurance company, and Charteree's Office. If the possible damages are not reported on time i.e. with any delay, Charterer is to kept responsible by himself and liable for his actions.

Insurance covers damages, against possible natural/environmental impacts, but it does not cover any damages done purposly. If damage is done purposly, Charterer will bear all expences by himself. Engine and Sails are not covered by insurance policy, and if any damage has happen, like lack of lubricating oil in engine, Charterer will be responsibile and will bear all expences. Personal belongings of crew are not covered by insurance.

Charter Contract Termination Terms
If the Charterer for any reason is not able to take over the yacht, he is entitled to, if mutually agreed, locate another Charterer personally, which will use the rights and agreed conditions of this contract.

If Charterer is not able i.e. not in position to find substitution for himself, Charteree will forced to retain following:
. 30% of the amount of charter fee for terminationof charter two ( 2) moths before charter commencement date. 50% of the amount of charter fee for termination of charter one (1) month before charter commencement date
. Charter Fee in total for termination within last month of commencement of charter date

If for some reasons like for ex.death of family member, health conditions and any other situations which may happen, the deposit will not be refunded F.Y.I. Chartereer will provide yacht to Charterer for any other free and/or available time or within next season.
Complaints
Both parties hereby agrees, that only written and dully signed complaints, are to be accepted and considered, during Hand Over Operations.
Arbitrage - Legal Claims
If any case occure, that can not be solved on mutual benefit, Croatian Law to Apply, in place of Charteree.

Shipyard:
The buildings and machinery of the shipyard is new near Istanbul. The management and workers are very experienced and built before many bigger yachts and copies like of Ferretti 80 with similar quality to Ferretti.
Because of this, the technologies they use is on the newest standards. The biggest advantage is that we built now in modern GRP composite, and not with wood laminated with GRP as the most Turkisch shipyards do.

Interior:
Because the shipyard have there own design department, they offer the customer to work with on the interior design to prepare for you the best suggestion. To give you and your customer security we can arrange to fix the quality in the contract and to have an independent surveyor from you/customer to guarantee the quality. In the case you like to visit the shipyard in Istanbul we can show you the possibilities and high standard quailty we can offer you.

Interior / Equipment:
The shipyard has there own design department, they offer the customer to work together with them on the interior design in order to satisfy clients requests and suggestions. Materials and Quality Shipyard is ISO 9001-2000 certified and posseses CE certificate for export to EU and other countries. Materials used during construction of yachts, subject to type, are DIAB composite technology, Monolitic hull, or Airex. Materials used for interior is subject to clients demands or requests.

Classification:
Any classification society standards are satified . Subject to country of client for ex. Lloyd, Rina, BV, CRS, ABS. If requested by client vessels can be delivered under Class survey, and also if the clients requests so , than technical drawings can be sent to classification society for pre-aproval. Upon official confirmation nor aproval of selected society and verification of documents, construction can start. Shipyard allows independent surveyors,apponited by clients, during constructions. Reason why this is mentioned is the fact that Turkey based shipyards products sometimes experience a technical difficulties during registration of vessel in EU. We suggest all possible clients a short trip to Turkey, Istanbul in order to convince themselfs in high standards and/or quality of yachts produced in shipyard.

Uvod
Kako Jadran na sjeveru gotovo dodiruje alpsko područje, to uzrokuje stanovite klimatske različitosti između sjevernog i južnog dijela. One nisu toliko zamjetljive ljeti, ali zimi se vremenske slike sjevera i juga često jasno razlikuju. Granica između dva lica istoga mora često se razabire prilično jasno - to je rt Ploča, znan među pomorcima i kao punta Planka, dvije milje južno od Rogoznice, na ruti od Šibenika prema Splitu.

 

Ciklone i anticiklone
Vremenske promjene na Jadranu diktira raspored ciklona i anticiklona nad srednjom i južnom Europom. Uobičajeni smjer kretanja ciklona nad Jadranom je od zapada prema istoku. Na svojoj prednjoj strani one donose vjetrove južnih smjerova (tada duž Jadrana najčešće puše jugo), s njima topliji i vlažan zrak, pa je vrijeme oblačno i kišno. Iza ciklone, s jačanjem anticiklone i njenim širenjem preko europskog kopna prema istoku, vjetar skreće na sjeveroistočne smjerove i donosi hladan i suh zrak, bura rastjeruje oblake, a nakon nje i privremenog zahlađenja vrijeme se stabilizira. Do nailaska nove ciklone prevladavat će vedro i mirno vrijeme, ljeti s umjerenim dnevnim vjetrom maestralom.

Ovakav je ritam izmjena za Jadran uobičajen, a razlikuje se tek po tome koliko često i kojim putanjama nailaze ciklone. Ljeti su rijetke i putuju uglavnom sjevernije od Jadrana, zimi snažne i duboke ciklone često putuju jedna za drugom s područja Genovskog zaljeva (tzv. genovska ciklona) i Tirenskog mora, pa preko južne Italije razno nad južni Jadran i dalje na jugoistok.

 

Razlike ljeti i zimi
Ljeti su razlike između sjevera i juga znatno blaže - dvije polovice jadrana spajaju se u tada jedinstveno klimatsko područje s mnogo toplih i sunčanih dana, visokim dnevnim temperaturama koje ublažavaju ugodni vjetrovi maestrali, niskim postotkom vlage i ne prevrućim noćima. Površinska temepratura mora uglavnom je cijelom duljinom Jadrana između 24o i 26o C.

Krajem ljeta razlike između sjevernog i južnog Jadrana postaju osjetne najprije noću, dok su dnevne temperature još neko vrijeme podjednake. Hladnije noći ubrzo dovode i do razlika u temperaturi mora, koje se s početkom rujna na sjeveru počinje brže hladiti. Mjesec dana kasnije pred Istrom će će se more već rashladiti i na 18o i manje, a na jugu i dalje može biti 22o C.

I temperature zraka zimi se prilično razlikuju. U Tršćanskom zaljevu i pod Velebitom snijeg uz more, nošen jakom burom, nije nikakva rijetkost, dok istodobno na Hvaru, Visu i Korčuli može biti posve ugodno vrijeme. Upravo tada, zimi, rt Ploča dokazuje da zaslužuje naziv klimatske granice - često se baš na njemu lome dva tipa vremena.

 

Morske mijene, struje i valovi
Plima i oseka u Jadranu su razmjerno malih amplituda i ne utječu bitno na sigurnost plovidbe. Ipak, za razliku od južnog dijela, gdje je razlika plime i oseke rijetko veća od 40 cm, što se više približavate sjevernom kraju Jadrana te će amplitude postati veće - uz Istru i u Tršćanskom zaljevu srednja ekstremna amplituda gotovo je 1m. U pojedinim uskim kanalima i zaljevima plima može za dugotrajnog i jakog juga izuzetno narasti, čak toliko da preplavi zidane obale u lučicama. Ova je pojava rijetka (češća zimi), a osobito je karakteristična za velike i duboke zaljeve južnog Jadrana. Za južna vremena plime su općenito pojačane, a za bure more je niže od prosjeka. Jadranske morske mijene su mješovitog karaktera i vrlo nepravilnih amplituda. Znatan učinak na njih ima i atmosferski tlak.

Morske su struje slabo izražene i u pravilu ne predstavljaju problem pri navigaciji. No o njima ipak treba voditi računa, jer u nekim uskim kanalima i prokopanim prolazima mogu dostići i 4 čvora brzine.

Valovi u Jadranu nisu onakvih visina kao na oceanima, ali to ne znači da ne mogu biti neugodni za manje brodove i brodice. Jugo stvara više valove nego bura (najveći izmjereni val juga od 10.8m, a bure 7.2m), no bilo bi posve pogrešno zaključiti kako su zato valovi juga opasniji. Upravo suprotno, valovi bure upola su kraći, a usto i znatno nepravilnijih amplituda, što znači da će brodski trup trpjeti mnogo veća naprezanja u valovima bure. Valovi maestrala postižu znatne visine na južnom dijelu Jadrana, a kod izuzetno pojačanog maestrala mogu dostići i do 4 m visine.

 

Vjetrovi Jadrana
Cijela istočna strana Jadrana obiluje posve osobitim lokalnim manifestacijama vremenskih mijena, naročito vjetrova. Od davnina je poznavanje sitnih znakova prirode temelj ribarskog i pomorskog života. Zato nećete pogriješiti ako upitate ribara kakvo će biti vrijeme do navečer ili sutra i gdje se najbolje vezati ili baciti sidro za noćenje.

 

Bura
Kao hladan vjetar, bura se okomito obrušava s uzobalnih vrhunaca prema moru. Pri tome podiže vodenu prašinu koja smanjuje vidljivost, a za čovjeka koji padne u more može biti kobna jer onemogućava disanje. Buru najavljuje "kapa" od oblaka koji kao da su se uhvatili za vrhove obalnih visokih planina - u sjevernom Jadranu Velebita, u južnom Mosora i Biokova. Nakon pojave "kape" do prvoga udara bure preostalo je vrlo malo vremena, a ovisno o žestini može se raditi o minutama ili najviše 2 sata.

Za male brodove ona je izrazito neugodna. Bez nje bi Jadran, a osobito sjeverni dio, bio puno pitomiji. Rijetko puše dulje od tri dana. Kad je lokalnog postanka može se ispuhati i za manje od 24 sata, no ako se radi o širokim, kontinentalnim rasporedima jake anticiklone i dubokih ciklona, zna potrajati cijeli tjedan (naročito zimi), a u tom razdoblju će nekoliko puta slabiti i jačati.

Nagla pojava bure jedna je od njezinih najopasnijih osobina, naročito za neiskusnije pomorce. Neposredno pred kopnom bura lako dostiže 40-50 čvorova, zimi i više. Kako donosi hladan i težak zrak, najradije pronalazi put prema moru kroz planinske rasjede i između viših masiva. Najveću snagu postiže tamo gdje je ubrzana ljevkastim reljefom kopna. Zato se od nje valja sklanjati u zaljeve usjećene pod planinom.

 

Jugo
Jugo je vjetar sa jugoistoka. Puše uzduž Jadrana, za nailaska ciklone nad jadransko područje. Donosi oblake i kišu. Tlak zraka pada. Razvija se sporo, obično se može primijetiti dva ili tri dana prije. Kako puše uzduž kanala, jugo razvija visoke, ali i dugačke valove. Obično traje znatno dulje od bure, pet do sedam dana. Zimi i dulje, nižući se u nekoliko naleta, a nebo se malo otvori.

Moguća su i takozvana suha juga, kad jugo puše više dana i ne donosi kišu, ali može biti olujne snage.

 

Maestral
Maestral je "dobar" vjetar, prijatelj osobito jedriličara i svih onih koji ljeti uživaju u moru jer razblažuje ljetne vrućine. To je dnevni termički sjeverozapadnjak što ga stvaraju razlike u brzini zagrijavanja kopna i mora. Uobičajen je od proljeća do jeseni, a najjači u srpnju i kolovozu.

Obično se podiže oko 9 ili 10 sati ujutro, popodne dostiže najveću snagu, da bi zalaskom sunca naglo zamro.

Na sjevernom Jadranu maestral je općenito slabiji nego na njegovom južnom dijelu, gdje se u kanalima među otocima može razviti do snage koja je neugodna za male brodice.

 

Nevera
Na Jadranu je nevera, uz buru, zasigurno najneugodniji doživljaj, posebno za posade malih plovila. Nevere su termičke vrtložne oluje koje najčešće dolaze velikom brzinom sa zapada, s otvorenog mora, traju kratko i imaju veliku snagu u uskom području lijevo i desno od svoje putanje. Javljaju se gotovo isključivo ljeti, znatno učestalije kako se približava jesen.

Na najmanji predznak nevere treba bez odgađanja poduzeti potrebne korake, jer vremena je malo. Ako postoji mogućnost sklanjanja ustranu od putanje nevere, najbolje je umaći.

Prije nailaska nevere vlada potpuna tišina, a često u posljednjim minutama pred provalu zapuše vrlo kratkotrajno lagani vjetrić prema neveri - on odnosi od vas izdajnički zvuk grmljavine, što je dodatni razlog da su mnogi dočekali neveru nespremni.

Kuna (1 Kuna = 100 Lipa). There are 1, 2, 5, 10, 20, 50 Lipa coins, 1, 2, 5 and 25 Kuna coins and 5, 10, 20, 50, 100, 200, 500 and 1,000 Kuna banknotes.

Foreign currencies can be exchanged at banks, exchange offices, post offices and at most tourist agencies, hotels and camping grounds. Banking hours are 7 a.m. to 7 p.m. from Monday to Friday. On Saturdays banks are open until 1 p.m. In the larger cities some banks are also open on Sundays. Credit cards: Most hotels, restaurants and shops accept credit cards (American Express, Diners Club, Eurocard/Mastercard, Visa, Sport Card International). Cash dispensing machines are ubiquitous.

Customs regulations:
Customs regulations of the Republic of Croatia are in line with the standards of European Union countries. Foreign currency is freely brought in and taken out of the country (up to a value of 3.000 euros); up to a value of 15.000 kn for domestic currency. More expensive professional and technical equipment should be registered at the border. Dogs and cats, accompanied by their owner, need to have an International certificate from a registered veterinarian stating that at least 15 days and not more than six months have passed since their vaccination against rabies. Tax refund for goods purchased in Croatia over 500 kuna in value with a validated "Tax cheque" at departure from the country. Purchase tax reimbursement for foreign citizens:
Tourists making purchases in Croatia (apart from petroleum derivatives) which exceed 500 Kuna per receipt may reclaim VAT ("PDV").

At point of purchase the sales person will provide on request a form PDV-P, which should be filled out and stamped, on the spot. On leaving Croatia the receipt must be verified by the Croatian Customs service. A PDV refund in Kuna can be obtained within six months, either at the same shop where the goods were purchased (in which case the tax is refunded immediately), or by posting the verified receipt back to the shop, together with the account number into which the refund should be paid. In this case the refund is dealt with within 15 days of receipt of the claim.

Medical service:
Foreign tourists do not pay for medical services if the Health Care Convention was signed between Croatia and the country they come from. Expenses of health services provided to persons coming from the countries with which the Health Care Convention was not signed are charged directly to users according to the price list. There are hospitals and clinics in all the major towns, and health centers, as well as pharmacies, in all the smaller places. For patients whose lives are in danger, there is emergency transport by air(helicopter) or sea (speadboat).

Working hours:
Shops and department stores are open between 8 a.m. and 8 p.m., and on Saturdays from 8 a.m. to 2 p.m., or to 3 p.m. A smaller number of stores close between noon and 4 p.m. Many stores are also open on Sundays, especially in the summer, and a smaller number in the larger cities are open 24 hours a day. Post and Telecommunications:
